8. President Andrew Johnson nominated Henry Stanbery to the Court in 1866 to replace John Catron. However, a hostile Congress reduced the size of the Court from 10 to 7, thus denying the appointment to Johnson and to Stanbery. Without Catron, the Court had nine justices and in 1869, the Congress acted to change the size of the Court to 9 with the departure of Johnson and the coming U.S. Grant as president.
